I see both the HT article and your points equally valid and relevant :-) Unable to take a stand on this, personally.

Gone through the HT article. Frankly speaking, the arguments are too lame. To me it seems bending over backwards to convince Pakistan. India has always suffered from the syndrome of taking the burden of proof on her own head. The way we handle terrorist proceedings just provides more motivation for terrorists.
Frankly speaking, we should accept that we can most probably aim to reach a stage where we could avoid and catch all terrorist attacks, given our situation. What we should be doing is to make the crime expensive for the terrorist by taking swift and stern actions ? It matters a lot if we have a terror in the minds of terrorists which will demotivate many of them from just jumping the side and perpetrating the crime.
One should always remember one law of war that is war should always be fought on other party's land because fighting a war in our own house will always cause harm to us. And unfortunately in the matters of national security, we have always been betrayed. It doesnt matter what the reasons were. So what if Prithvi Raj Chauhan defeated Mohammad Gauri many times but not wiping him costed huge loss of lives in Delhi. Similarly when we lost to China, we lost strategic locations of Aksai Chin.
Am not debating fair trial to Kasab but this has been a trend. What happened to Afzal Guru ? Surely we must be having another story and explanation for him too. In his case he has been sentenced to death but his pardon plea has been pending with President.
